O R D E R

% 27.02.2018 By this petition the petitioner seeks anticipatory bail in case FIR No.565/2017 under Sections 420/467/468/471 IPC registered at PS Roop Nagar.

The allegations against the petitioner in the above-noted FIR based on the complaint of one Gurjeet Singh are that Gurjeet Singh was a service provider to Reliance Life Insurance Limited having its office at Barakhamba Road, Connaught Place, New Delhi. Gurjeet Singh stated that one of his customers namely Pankaj Jain had alived one Policy bearing No. 13358357 Reliance total investment plan series. This policy was issued on 31st December 2008 for a premium of ₹25,000/-. The customer visited the branch at Shivpuri MP and asked the procedure for surrendering the policy when he was informed that the policy bearing No. 13358357 had already been surrendered. Pankaj Jain stated that he had never applied for surrender

of his policy, hence Pankaj Jain filed a complaint in the office of Reliance Insurance Company Limited, Shivpuri MP.

It is the case of the prosecution that during the course of investigation it was revealed that the petitioner was not having any policy but still he applied for surrender of the policy on the strength of forged documents and procured the policy in his account. The sum of ₹44,387/- was transferred to the account of the petitioner.

Learned counsel for the petitioner on 28th June, 2017 when the present petition came up for hearing expressed his desire to deposit the amount of ₹44,386.68 with the Registrar General of this Court within a week. A report has been received from the Registry noting that a sum of ₹44,386.68 has been deposited by the petitioner with the Registrar General of this Court. Considering the bona-fide showed by the petitioner and the fact that the petitioner has joined the investigation, this Court deems it fit to grant anticipatory bail to the petitioner.

It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety bond of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned and in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit. The deposit of ₹44,386.68 made by the petitioner before the Registrar General of this Court will be kept in fixed deposit and would be subject to final outcome in the trial or settlement if any between the parties.

Petition is disposed of. Order dasti.
