O.M.P.(I) (COMM.) 433/2016 After some arguments, the learned counsels for parties have agreed that an independent Arbitrator be appointed by this Court immediately and the petitioner be given liberty to move the arbitrator for all interim reliefs before the Arbitrator. Accordingly, with the consent of the parties, Mr Samrat K Nigam, Advocate, (Mobile No.9810424476) is appointed as the sole Arbitrator, to adjudicate the disputes between the parties. The Fees of the Arbitrator shall be fixed in consultations with the parties. This is subject to the disclosure being made under Section 12(1) of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act') and O.M.P.(I) (COMM.) 433/2016 Page 1 of 2

subject to the qualifications under Section 12(5) of the Act. The parties shall approach the Arbitrator for preliminary hearing on 10.11.2016 at 03.00PM.

The petition stands disposed of.

Copy of the order be given dasti to both the parties under signature of the Court Master.
