% 23.02.2018 Mediation has failed. However, it is submitted that petitioner and complainant have settled their disputes amicably. Learned counsel for complainant is present in the Court and admits the factum of settlement arrived at between the petitioner and complainant/ respondent no.2. It is submitted that marriage between petitioner and respondent no.2 has already been dissolved by a decree of divorce by mutual consent and out of settled amount of `6,00,000/- , `4,00,000/- has already been paid to respondent no.2 and as per the Compromise Deed, balance settled amount of `2,00,000/- shall be paid at the time of quashing of FIR for which an appropriate petition would be filed in due course.
Keeping in mind the totality of facts and circumstances, it is
ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
