CORAM:

HON'BLE MR. JUSTICE SANJIV KHANNA HON'BLE MR. JUSTICE CHANDER SHEKHAR

O R D E R

% 11.11.2016 This writ petition by Bharat Bhushan Allhabadi impugns an adjournment order and prays for a direction that the Financial Commissioner, the fourth respondent before us, should be directed to expeditiously dispose of the revision Petition No.169/2015. We fail to understand the anxiety and haste shown by the petitioner. Division Bench of this court vide order dated 12th August, 2016 in CM.No.22539/2006 in WP(C) No.4042/2006 has already requested the Financial Commissioner to hear and dispose of the revision petition at the earliest convenience. Bharat Bhushan Allahabad had Writ Petition (C) No.4042/2016,

without impleading Ekta Cooperative Group Housing Society Limited, as a party.

The petitioner had concealed and not pointed out that a review petition filed by the Cooperative Society against the order of the Registrar Cooperative Society directing inspection was pending before the Financial Commissioner and an interim order of stay of inspection was passed. The suppression of facts was adversely commented upon. The petitioner is member of the aforesaid Cooperative Society and was its secretary. Petitioner has grievances against other members including the members of the Management Committee.

In the order dated 12th August, 2016, the Financial Commissioner has been requested to hear and dispose of the revision petition at the earliest. It is obvious that the Financial Commissioner has to fix the date of hearing as per his convenience and while fixing a date he will take into consideration urgency in this case and in another cases.

It will not be appropriate and proper for us to issue any more or further directions. The writ petition is accordingly dismissed.
