O R D E R
% 17.09.2018 The fact that the petitioner's wife requires surgery for removal of fibroids in her ovary is not in doubt. However, the doctor has denied that he has written 'Admission Ward 4, DOB Operation 19/9/2018' as shown D to D on the Out Patient Card of petitioner's wife on 29.08.2018. Be that as it may, insofar as the petitioner's wife requires surgery and she has no one else to take care of her, she cannot be left at the mercy of the elements. The petitioner's address has been verified. His conduct in jail has been found satisfactory. He has recently surrendered before the Jail Authorities on the expiry of parole.
In view of the foregoing, the Court finds no impediment in allowing the present petition. Consequently, the petitioner is granted parole for a period of one month from the date of his release on his furnishing a personal
bond in the sum of Rs.15,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent concerned, subject to the following conditions:- (1) The petitioner shall report to the SHO concerned Police Station Adarsh Nagar, Delhi, once a week on every Tuesday during the period of parole;
(2) He shall furnish his telephone number, which shall be kept operational at all times, to the SHO concerned; (3) He shall not leave the territory of NCT of Delhi; (4) The petitioner shall surrender before the jail authorities at the expiry of the period of parole.
With the above directions, the writ petition is disposed-off. A copy of this order be given dasti to the learned counsel for the parties under signature of the Court Master and a copy be sent to the Jail Superintendent concerned, for compliance.
