% 25.11.2016 Learned counsel appearing for the petitioner submits that the appeal of the respondents under section 9 of the Public Premises Act came up for hearing before the District Judge on 9.11.2015. On that date the District Court passed an ex parte order staying the order of the Estate Officer. He submits that more than an year has lapsed and the matter is still pending. He relies upon section 9(4) of the Act to submit that the appellate court was to dispose of the appeal within one month of the filing of the appeal. Learned counsel appearing for the respondent has pointed out that the petitioners themselves have been delaying the matter. He further points out that some discrepancy has also been noted in the record of the Estate Officer Further he points out to various orders from where it is clear that the court has heard detailed arguments which could not be concluded. Further on 18.7.2016 the matter was transferred to another Court. Be that as it may, the concerned court is requested to expeditiously CM(M)1117/2016

deal with the matter and dispose of the same keeping in view the above specific provisions. The present petition stands disposed of. All pending applications, if any, also stand disposed of accordingly. JAYANT NATH, J.
