This first appeal under Section 96 of the Code of Civil Procedure, 1908 (CPC) impugns an ex-parte money decree in Suit No.79/2013 of the Court of Additional District Judge (ADJ)-04, South District, Saket Courts, New Delhi.

Notice of the appeal was issued and thereafter the matter was adjourned from time to time on the plea of the appellants attempting a settlement with the respondent Bank.

None appeared for the parties on 20th November, 2015; however adverse orders were deferred. None appears for the appellants today. 4.

The counsel for the respondent Bank informs that though upon the appellants approaching the respondent Bank a conditional settlement was arrived at but the appellants did not comply with the same also and have now stopped approaching the respondent Bank as well. 5.

Dismissed in default.
