% 06.01.2017 The petitioner seeks the interim bail under Section 439 Cr.P.C. in case FIR No. 92/2010 registered at police station Nihal Vihar under Sections 302/120-B/34 IPC and 25/27/54/59 of the Arms Act. The petitioner is in judicial custody since 01.12.2010.
The submission of learned counsel for the petitioner is that the prosecution has led its evidence. The stage in the case is the recording of the petitioner's statement under Section 313 Cr.P.C. The petitioner seeks interim bail on the ground of medical condition of his wife. She is suffering from psychiatric disorder. The petitioner has placed on record documents to establish the said position. Learned counsel submits that even earlier, the
petitioner has been granted interim bail on the same ground. So far as the children of the petitioner are concerned, both are studying outside Delhi. This position is also substantiated by the documents which has been got verified by the investigating officer.
In view of the aforesaid position, the petition is allowed and the petitioner is directed to be released on interim bail for a period of four weeks on his furnishing personal bond in the sum of Rs. One lakh with two sureties in the amount of Rs. 50,000/- each, to the satisfaction of the trial court. This is further subject to the condition that the petitioner shall mark his attendance at the local police station after every three days. The petitioner shall provide his mobile number to the trial court which shall be kept in working condition at all the times and shall not be changed without prior intimation of the court. He shall also attend each and every date of hearing before the trial court and not seek any adjournment in this regard. Dasti to the parties.
The bail application stands disposed of.
