O R D E R

% 13.09.2025 Appellant has filed an appeal for enhancement of the award dated 20.08.2014 passed by the learned MACT awarding compensation of Rs.17,81,310/- along with interest @ 9% from the date of filing of the claim petition.

Application of the appellant for bringing of record the legal heirs of the deceased was allowed by this Hon'ble High Court vide order dated 16.07.2025.

We have interacted with the learned counsel/parties concerned. Apropos such interaction and deliberation, the parties have agreed that respondent- INSURANCE COMPANY LTD shall pay Rs.4,10,000/- over and above the compensation granted by the learned Tribunal. In turn, the appellant has also agreed that the aforesaid enhanced amount shall be towards full and final settlement of all the claims involved in the appeal. It is prayed that the appeal be disposed of in aforesaid terms.

As such, respondent - INSURANCE COMPANY LTD is directed to deposit enhanced amount of Rs.4,10,000/- before the learned Registrar General of this Court within a period of six weeks from today failing the respondent shall be liable to pay interest @ 9 per cent per annum for the delayed period. Learned Registrar General shall release the said amount in favour of appellant No.1 to 3 in the ratio of 50%, 25% & 25% respectively, subject to verification and completion of requisite formalities.

In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of.

A copy of this order be sent to the concerned learned Tribunal with LCR, if already received.
