On 19.11.2024, Court observed that there was no appearance on behalf of the Plaintiffs even on the second call. Default notice was issued to the Plaintiffs as well as to the learned counsel indicating the next date of hearing. Court had made clear that if there was no appearance on behalf of the Plaintiffs on the next date of hearing, suit will be dismissed for nonprosecution. Order dated 13.12.2024 also records that there was no appearance on behalf of the Plaintiffs.

The suit relates to the year 2015 and learned counsel for the Defendant submits that Plaintiffs have not stepped into the witness box for cross-examination.

It appears that Plaintiffs are not interested in prosecuting the suit and the same is accordingly dismissed for non-prosecution and in default.
