O R D E R

% 06.07.2017 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner for quashing of FIR No.23/2010, under Sections 419/420/468/471 IPC, registered at Police Station C.R.Park, New Delhi. Learned counsel for the petitioner has submitted that the petitioner is a young boy of 29 years and due to the misunderstanding arisen between the petitioner and the complainant, the complainant got registered the aforesaid FIR against the petitioner. Counsel further submits that the allegation qua against the petitioner is of impersonation to the effect that he is the employee of HSBC Bank. However, the HSBC Bank has not filed any complaint against the petitioner nor put any allegation qua against the petitioner till date. Counsel further submits that after the registration of the FIR, the near relatives and friends intervened and the matter has been amicably settled between the parties and the said settlement has been reduced into writing on 4th October, 2014. Counsel further submits that since

the matter has been amicably settled between the parties and nothing further remains to be adjudicated, the aforesaid FIR which is coming as hurdle in the peaceful life of the petitioner, may be quashed. The respondent No.2/complainant is present in person and has been identified by the IO SI Ajeet Kumar, P.S. C.R.Park, New Delhi. The respondent No.2/complainant, present in person, admits that he has amicably settled the matter with the petitioner and the same has been reduced into writing on 4.10.2014 and nothing further remains to be adjudicated between the parties and he has no objection if the FIR and all proceedings arising therefrom is quashed.

Looking into the above facts and circumstances, since the dispute has been amicably settled between the parties and the same has been reduced into writing on 04.10.2014 and nothing further remains to be adjudicated between the parties, to have peace and better relations in present and in near future, I deem it appropriate to quash the FIR in question and all subsequent proceedings arising therefrom.

Consequently, FIR No.23/2010, under Sections 419/420/468/471 IPC, registered at Police Station C.R.Park, New Delhi and all subsequent proceedings arising therefrom are quashed. Parties shall remain bound by the settlement.

The present petition is allowed and stands disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J JULY 06, 2017 'dc'
