Considering that the arbitration clause in the agreement stipulates that the arbitration will take place in Calcutta and the jurisdiction will be exclusively that of the courts at Calcutta, learned counsel for the Petitioner seeks leave to withdraw this petition to approach the High Court at Calcutta.

2. The petition is dismissed as withdrawn with liberty as prayed for. This is without prejudice to the rights and contentions of the Respondent.

3. Order dasti.
