On the last date of hearing, learned counsel for the respondents was directed to obtain instructions as to the number of vacancies, if any, available in respect of Code-7, Ex-Servicemen (OBC), subject matter of the Notice dated 19.01.2013, issued by the respondents/SSC for the Combined Graduate Level Examination, 2013. It was observed that if there are vacancies available, then the same shall be intimated on the next date and only then would the Court hear the arguments on the merits of the case. 2.

Learned counsel for the respondents state on instructions that there are no vacancies available, in terms of the Notice dated 19.01.2013, issued for filling up the subject post.

We are informed by learned counsel for respondents that even after the year 2013, regular advertisements have been issued by the respondents for conducting Combined Graduate Level Examinations in the years 2014, 2015 & 2016 and if the petitioner had missed an opportunity of acquiring the status of an Ex-Servicemen (OBC) in the year 2013, he could have easily participated in the examinations conducted in the subsequent years. 4.

In view of the fact that as on date, there are no vacancies available for the subject posts that were to be filled up by conducting the Combined Graduate level Examination, 2013, no useful purpose shall be served by hearing learned counsel for the petitioner on the merits of the case. 5.

The present petition is accordingly disposed of. HIMA KOHLI, J.
