% 13.07.2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner for grant of bail in case FIR No.702/2016, under Sections 420/468/471 IPC, registered at Police Station Bindapur, Delhi. Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 26.05.2017. Counsel further submits that the investigation is in progress and nothing is to be recovered from or at the instance of the petitioner and no purpose would be served if the petitioner is kept in judicial custody for an indefinite period. Learned APP for the State along with the IO opposes the bail application and submitted that the petitioner was arrested on 26.05.2017 and the allegation against the petitioner is that of obtaining sales tax registration
number fraudulently on the basis of forged documents and the investigation is in the progress.
Looking into the aforesaid facts and circumstances, since the petitioner is in judicial custody since 26.05.2017 and nothing is to be recovered from the petitioner, I admit the petitioner on bail, on his furnishing bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Court with the condition that the petitioner shall not leave the country without the prior permission of the Court and shall not tamper with the prosecution evidence in any manner. The present bail application is allowed and stands disposed of accordingly.
