LPA No.638/2016 & CM No.42238/2016 (stay) Heard both parties.

The only grievance of the appellant before us is that if the vacancies are filled up pursuant to the vacancy notice No.RCIL/2015/E&A/44/16 by which online applications have been invited for appointment to the post of Deputy Manager (Technical) (E-11), the writ petition would be rendered infructuous.

We are, therefore, of the view that it would be appropriate to advance the hearing of CM No.36870/2016. The learned counsel for both the parties agreed for the same.

Accordingly, the date already fixed for hearing of CM No.36870/2016 as 18.01.2017 shall stand cancelled and the said application be listed before the Roster Bench on 30.11.2016 for directions.

We request the learned Single Judge to hear CM No.36870/2016 on 30.11.2016 or any other day as per convenience and decide the same expeditiously.

Appeal is accordingly disposed of.
