% 16.08.2018 After some hearing, the learned counsel for the petitioners, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith, reserving all the contentions set out in the petition as arguments against framing of charge, the matter being pending at that stage before the trial court, cognizance having been taken on the charge sheet which was submitted on 04.11.2015. Further, the petitioners may be given liberty to move the trial court seeking exemption from personal appearance.
The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. CRL.M.C. 4237/2016
The applications for grant of exemption from their personal appearance shall be considered and necessary order passed by the trial court in accordance with law.
