2. Since Justice. S.K. Mahajan, the sole Arbitrator appointed by this Court by its order dated 27th February 2015 in Arb..P. 670 of 2014 has expired, the present petition has been filed seeking the appointment of another Arbitrator.

3. Notice. Ms. Geeta Mehrotra, learned counsel accepts notice on behalf of the Respondent. She has produced a copy of letter dated 27th October 2016 addressed to the Petitioner whereby the Petitioner has been asked to opt for one of the names on the panel of arbitrators of the Respondent. O.M.P. (T) (COMM.) 71/2016

4. The Court accordingly appoints Justice Dilip Raoshaeb Deshmukh, a former Judge of the High Court of Chhattisgarh, residing at B-171, First Floor, Sector-44, Noida whose name figures in the panel of the Respondent) as sole Arbitrator to adjudicate the disputes between the parties.. The learned Arbitrator will proceed from the stage at which the proceedings were when the previous Arbitrator expired. The terms of the learned Arbitrator will be in accordance with those prescribed by the Respondent for its panel arbitrators.
