O R D E R

% 13.10.2017 Today, learned counsel for the defendant, on instructions from Mr Neeraj Parmar, AVP (Legal), who is personally present in court, states that the suit premises shall be vacated on or before 30th April, 2018.

She further states that a sum of Rs 10 lakhs, as part payment for rent for the month of October, 2017, has been paid today to the learned counsel for the plaintiff. She also assures this court that the balance amount of rent for the month of October, 2017 shall be paid on or before 30th October, 2017.

She assures this court that future rents from the month of November, 2017 will be paid by 15th day of each month. She also states that the arrears of rent upto September, 2017

would be cleared in three equal monthly instalments commencing February to April, 2018.

Learned counsel for the plaintiff has no objection to the present suit being decreed in the aforesaid terms. The statements, assurances and undertakings given by both the counsel are accepted by this court and both the parties are held bound by the same. It is clarified that in the event of any default in compliance of the aforesaid terms, the plaintiff shall be at liberty to execute the decree forthwith.

Consequently, the present suit is decreed in terms of the aforesaid terms, assurances and undertakings given by the learned counsel for the defendant. All pending applications also stand disposed of.

The Registry is directed to prepare a decree sheet accordingly. As a token of acceptance of today‟s order, Mr Neeraj Parmar, AVP (Legal) is directed to sign the order-sheet. R.O. & A.C.
