W.P.(CRL) 3187/2016 Issue notice. Notice is accepted on behalf of the State. Mr. Kundu points out that the charge sheet already stands filed in case FIR No.364/2011 under Section 120B/420/468/471 IPC registered at PS Seemapuri, and the next date fixed before the Trial Court is 05.01.2017. Let a copy of the charge sheet be provided to learned counsel for the petitioner during the course of the day. It shall be open to the petitioner to examine the same and take necessary steps as he may be advised to take in the case.

Learned counsel for the petitioner submits that he shall also independently take steps to assail the order dated 15.10.2011 whereby the proceedings in CC No.80/2011, titled Anil Behal v. Shiv Kumar & Ors. has been adjourned sine die on account of the registration of the FIR in question. Dismissed as withdrawn with liberty to assail the order dated 15.10.2011 and take such steps in respect of the charge sheet stated to have been filed in case FIR No.364/2011, as the petitioner may be advised.
