Counsel for the appellant states that as per the orders passed in the other connected cases, the appellant has paid costs of Rs.1,500/- to the RFA 44/2017 Page 1 of 2

respondent through counsel for condonation of delay of 8 days in filing the appeal, which fact is confirmed by the counsel for the respondent, who appears on advance notice and states that he shall be filing his power of attorney within two days.

The application is disposed of.

RFA 44/2017 and CM APPL. 1341/2017 (stay) 1.

Counsel for the appellant hands over a composite statement reflecting the tentative date of payment proposed to be released to the respondent in respect of the four work orders executed by him. A copy of the same has been furnished to the counsel for the respondents, who states that his client is agreeable to the said proposal.

Both the parties states that the present appeal may be disposed of on the same lines as was done in the connected appeals filed by the appellant/EDMC, wherein the lead case was RFA 192/2016. 3.

Accordingly, the present appeal is disposed of alongwith the pending application in terms of the order dated 01.12.2016 passed in a batch of appeals preferred by the appellant/EDMC, lead matter being RFA 192//2016, while leaving the parties to bear their own expenses.
