% 06.12.2016 The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR Nos. 195/16 registered under Sections 420/467/468/471/120B IPC registered at police station Preet Vihar. The petitioner is in judicial custody since 23.06.2016. The charge-sheet stands filed in the case. The status report filed on record shows that the petitioner is accused of conspiracy on account of the fact that his mobile phone had been used in the course of conspiracy. The mobile phone of the petitioner has been seized. It is pointed out by learned counsel for the petitioner that the three prime accused, namely, Balwant Singh, Harmeet and Udit Prajapati have all been released on bail. He, therefore, seeks parity. I am of the view that the petitioner is entitled to parity for the role allegedly played by him in the
conspiracy.
Accordingly, the present bail application is allowed. The petitioner is directed to be released on bail subject to his furnishing personal bond in the sum of Rs. 20,000/- with one surety in the like amount to the satisfaction of the trial court. This is further subject to the condition that he shall provide his mobile phone number which shall not be changed and shall be kept in working condition at all the times and that he shall not seek to influence the other prosecution witnesses or to tamper with the prosecution evidence. The petition stands disposed of in the above terms. Dasti.
