Though the application is titled as for modification of the order but in fact the plaintiffs thereby seek a direction to the probate Court to decide the probate case within one year.

No occasion therefor arises.

Moreover, the Court in which the probate case is pending is a zero pendency Court and if the plaintiffs and the other party cooperate, the probate case can be disposed of in less than one year. 4.

The application is dismissed.

The counsel for the plaintiffs at this stage withdraws the application. 6.

Dismissed as withdrawn.
