% 14.12.2016 Matter has been taken up today as 12th December, 2016 was declared holiday on account of Milad-Un-Nabi (birthday of Prophet Mohammad). On the complaint of respondent no.2, present FIR No.376/2013 under Sections 420/406/120B/34 IPC was registered at police station Mandawali against petitioner. Disputes arose between petitioner and respondent no.2 in respect of property transaction which resulted in the registration of the present FIR.
Petitioner and respondent no.2 have settled their disputes before the Delhi High Court Mediation and Conciliation Centre vide Settlement Agreement dated 3rd March, 2015.
CS(OS) no.429/2013 and CCP(O) 98/2014 have also been settled vide Settlement Agreement dated 3rd
March, 2015.
It is contended that respondent no.2 has already paid `75 Lakhs to petitioner.
Petitioner as well as respondent no.2 have been identified by SI Praveen Kumar PS Mandawali. Respondent no.2 submits that he is not willing to pursue the FIR any further in view of the settlement arrived at between him and petitioner before the Mediation Centre. Keeping in mind the fact that disputes arose between the parties over the property transaction, which they have now settled, in the interest of justice, FIR No.376/2013 under Sections 420/406/120B/34 IPC registered at police station Mandawali, which is at the initial stage, is quashed in view of settlement arrived at between petitioner and respondent no.2. Petition is disposed of in the above terms.
