1. Learned counsel for the Respondent states that there is no objection to the Court appointing a sole Arbitrator to adjudicate the disputes between the parties.

2. It is ordered that the arbitration by a Sole Arbitrator shall take place under the aegis of the Delhi International Arbitration Centre ('DAC').

3. The parties will appear before the DAC on 7th March, 2017 at 11:00 am for further steps in this regard.

4. It is clarified that notwithstanding the order dated 1st December, 2016, the learned Arbitrator will consider on merits the plea of the Petitioner that the Respondent was acting as an Agent of some other entities who were not ARB.P. 764/2016

party to the arbitration agreement. This is without prejudice to the contentions of the Respondent to the contrary.
