% 07.11.2016 The petitioner is aggrieved by the illegal and unauthorized construction which is being permitted at the hands of respondent No.5 in property bearing No. 2734, Gali Peepal Wali, Mohallan Niyariyan, G.B. Road, Delhi. Contention is that this construction is not only illegal and unauthorized but is being permitted to be carried out by the private respondents which can only be done with the connivance with the officials of the respondents/Department.

On advance notice, learned counsel for the respondent/North Delhi Municipal Corporation has put her appearance. Her submission is that the property stands booked and all necessary actions against the alleged illegal and unauthorized constructions will be taken in

accordance with law. Her further submission is that the next date of hearing on the proposed demolition order to be passed is fixed for 10.11.2016. The undertaking of the respondent is taken on record. It is noted that this undertaking shall be honoured in true letters and spirit and the demolition action against the unauthorized constructions will be taken in accordance with law.

No further orders are called for on this petition. It is disposed of.
