% 12.02.2019 Mr. Bhardwaj, learned counsel for the petitioner submits that during the pendency of the present petition, the petitioner has been removed from service on account of an alleged misconduct.

In the present petition, the petitioner had challenged his transfer from Delhi to Shillong. In view of the aforesaid development, unless the removal from service of the petitioner is set aside or recalled, this petition will not survive. Accordingly, we dispose of this petition, preserving the rights and contentions of the parties with liberty to the petitioner to revive the same if and when the occasion arises. However, we make it clear that the observations made in the impugned order shall not have any bearing on the pleas of the petitioner in extending challenge to his removal.
