O R D E R

% 20.12.2016 Crl. M.A. 19821/2016 (u/Sec. 147 of N.I. Act read with Section 482 Cr.P.C.) It is submitted that petitioner (convict) and respondent no.2 (complainant) have settled their disputes amicably for ` 10 lacs. Petitioner has already paid the settled amount of `10 lacs to the respondent no.2. Photocopy of the settlement agreement dated 16th December, 2016 along with receipt has been annexed with this application. It is submitted that settlement agreement has been signed by the wife of the petitioner on behalf of the petitioner. Respondent no.2 is present in Court along with his counsel. He submits that he has no objection in case the offence is compounded. In view of the settlement arrived at between the petitioner and respondent no.2 and that entire settled amount has been received by the

respondent no.2, the application is allowed and offence under Section 138 of the Negotiable Instruments Act, 1881 is permitted to be compounded. Petitioner is acquitted. Petitioner is in jail. He be released forthwith, if not required in any other case. Revision petition is also disposed of. Date fixed in the matter, i.e., 15th February, 2017 is cancelled. Copy of the order be sent to the concerned Jail Superintendent for compliance.
