% 27.02.2017 The learned counsel for the appellants submits that the hearing on IA No.11239/2009 under Order XXXIX Rule 1 & 2 CPC and IA No.19537/2013 under Section 151 CPC of the defendant have been taken up for hearing and are being heard. The next date in the matter is 07.03.2017. He submits that in view of the fact that the applications are being heard by the learned single Judge, he does not press the appeal any further inasmuch as it has become infructuous at this stage.

The appeal stands disposed of as such.
