% 14.03.2018 After some hearing, the learned counsel appearing for the petitioner, on instructions, submits that he may be permitted to withdraw the present petition as the petitioner reserves the right to institute separate proceedings against the parties whose re-impleadment was sought, declined by the impugned order 26.09.2016 with reference to the fresh cause of action arising on account of they having failed to abide by the terms of settlement earlier entered upon.

The petition is dismissed as withdrawn with liberty as prayed for granted.
