% 16.12.2016 After some arguments learned counsel appearing for the petitioner submits that he would not like to press the present petition. He, however, submits that as amendment of the plaint has been permitted by the impugned order, he should be allowed to file an appropriate written statement which he submits that the trial court has declined.

The petitioner is permitted to file an application for recall/review, limited to the said submission before the trial court. In case such an application is filed the trial court is requested to deal with the same as per law.

Petition stands dismissed as withdrawn. All pending applications, if any, also stand disposed of accordingly.
