O R D E R

% 22.11.2016 Present contempt petition has been filed alleging wilful disobedience of the order dated 24th August, 2016 passed by a coordinate Bench of this Court in RFA 444/2016 whereby the appeal preferred by the respondent-son against judgment and decree dated 17th February, 2016 was disposed of in view of the statement made by the counsel for respondent-son that he shall vacate the property bearing No. RZ-1/5A, Gali No.4, Tughlakabad, New Delhi, on or before 30th September, 2016.

In the petition, it has been averred that despite the aforesaid order, the respondent-son had failed to furnish the undertaking and/or to vacate the aforesaid property on or before 30th September, 2016.

However, during the course of arguments it transpires that respondent-son has now vacated the premises on 4th November, 2016. Consequently, this Court is of the opinion that no further orders are called for in the present contempt petition, especially keeping in view the close relationship between the parties.

Accordingly, present contempt petition and application are disposed of.
