% 18.05.2016 1.

The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No. 34/2015 registered under Sections 392/394/34 IPC at PS Tilak Nagar. Status report is on record.

2.

I have heard the learned counsel for the parties and have examined the file. Petitioner's counsel urged that the petitioner has been falsely implicated in this case as his father had lodged complaints against the complainant being the police informer prior to the registration of the FIR. Ingredients of Section 392 IPC are not attracted. The petitioner was not present at the spot and number of affidavits have been filed on record to show that he was available at his place of work at the time of occurrence.

BAIL APPLN. 1131/2015

3.

Learned APP urged that the petitioner has been specifically named in the FIR. Injuries sustained by the victim were 'serious' in nature. There is alteration in the attendance-sheet over time. 4.

Vide order dated 08.06.2015, the petitioner was granted interim protection and was directed to join the investigation as and when required. It is informed that the charge-sheet has since been filed. 5.

Since the petitioner has enjoyed interim protection since 08.06.2015 and charge-sheet has now been filed, let the petitioner seek regular bail before the Trial Court.

He is granted interim protection from arrest for two weeks to enable him to seek regular bail. The Trial Court shall deal with the application for regular bail on merits uninfluenced by the interim protection granted by this Court.

6.

The bail application stands disposed of.

7.

Copy of the order be sent to the Court concerned for information.

8.

Order 'dasti.'
