O R D E R

% 28.07.2017 Petitioner is aggrieved by the fact that although he was entitled to 40 marks for his sport certificate (entitling him the admission in Sport Quota of the Delhi University) he has been denied the same; this was because due to inadvertence the petitioner had uploaded a wrong certificate. The certificate which had been uploaded by the petitioner (only one certificate was permitted to be uploaded) is at page 34 of the paper book. Learned counsel for the petitioner points out that the petitioner had approached the 'Help Desk' of the respondent wherein he had been informed that this certificate would work in his favour. It, however, did not work. Learned counsel for the respondent disputes this submission; it is pointed out that there is no 'Help Desk'.

Counter affidavit has been filed by the respondent. Learned counsel for the respondent points out that had the petitioner uploaded either of the two certificates (at page 29 or page 30 of the paper book) he would have been awarded 29 marks out of 40 marks. Noting these facts and noting the additional submission of the learned counsel for the petitioner that in the trial run, the petitioner had secured a 1st position meaning thereby that he almost qualified as a champion in Tennis; this court is of the view that his entitlement which has now fallen short (due to inadvertence) be considered in the sport quota, this mistake should not become a hurdle for his admission.

Accordingly, this court is of the view that the benefit of the best certificate which is available with the petitioner (part of the record) shall be given by the respondent and the same shall be considered by for entitlement of the petitioner to the marks which he deserves in the sport category. His case be considered accordingly. Petition disposed of.
