% 02.01.2017 CM 48018/2016 & FAO(OS) 317/2016 This is an application for early hearing. The next date fixed in the matter is 24.01.2017.

The date before the learned Single Judge is 16.01.2017. The learned counsel for the appellant/applicant submits that he shall not be pursuing this appeal in case the learned Single Judge takes up the appellant's application under Order 39 Rule 4 CPC as well as the respondents' application under Order 39 Rules 1 & 2 CPC for hearing and disposing of the same. Apparently, the respondent no.2 has also filed an application under Order 39 Rule 4 CPC which is also pending before the learned Single Judge.

Consequently, we dispose of this application as well as the appeal with a request that the learned Single Judge shall take up these applications for hearing on 16.01.2017 itself.

The application and the appeal stand disposed of as above. We are making it clear that we have not expressed any opinion on the merits of the case.
