O R D E R
% 30.11.2016 On the last date of hearing, this Court had passed the following order:- "Learned counsel for the petitioner submits that the petitioner is not seeking change of name, however, is seeking correction in the spelling of the name.
Learned counsel for the respondent submits that the last date for filling up the Class Xth Form was 31.10.2016 and on account of the spelling error the son of the petitioner has not been able to fill up the form.
Issue notice. Notice is accepted by the learned counsel appearing for respondent no.1.
The petitioner is permitted to fill up the Class Xth Form with the correct spelling subject to further orders of the Court. The respondent no.2 is directed to accept the corrected form with the correct name and accordingly in the list to be forwarded to respondent no.2, the correct spelling as filled up by the petitioner be mentioned.
Dasti notice shall issue to respondent no.2, returnable on 30.11.2016.
Copy of the order be given dasti under signatures of the Court Master."
I have been informed that class 10th form has been filled by the petitioner correcting the spelling of his name as „Pradhyumn Mittal‟. Mr. Atul Kumar, has pointed out the relevant corrections having been made in the records of the school and the same has been forwarded to the CBSE. The learned counsel for the petitioner also states that pursuant to the newspaper publication dated 19th October, 2016, he has applied to the concerned authority for gazette notification. He states that the gazette notification shall be issued in a week‟s time. If that be so, the petitioner shall submit to the respondent no.1 copy of the gazette notification for their records.
As the necessary correction has already been carried out by the school and forwarded the same to CBSE, it is expected that CBSE shall reflect the correct name of the petitioner in the admit card and also the certificate to be issued.
The petition is disposed of.
