O R D E R

% 21.02.2017 Reply affidavit has been filed by the respondent wherein in para 4, the respondent has stated as under:- "That it is submitted that after issuance of letter dated 07.04,2016, at the request of the petitioner institution, the inspectors appointed by the answering respondent inspected the institution and submitted their report. The report of the inspection was placed before the competent authority and after due consideration it was decided to permit the petitioner institution to conduct GNM course with an intake capacity of 30 seats for the academic year 2016-17. True copy of letter of permission dated 28.10.2016 is annexed and marked as Annexure R-1."

In support of the stand, they have annexed a letter dated 28th October, 2016 annexure R-1. According to the learned counsel for the petitioner, the copy of the letter sent to the petitioner does not depict the correct address of the petitioner. Learned counsel for the respondent states that the petitioner

shall be at liberty to make a representation to the respondent for correction of the address. The statement is taken on record. In view of the statement made by the learned counsel for the respondent, Mr.Mayank Manish, states that the present petition has become infructuous and he wishes to withdraw the same. The petition is dismissed as withdrawn.
