% 19.09.2019 CS (COMM) 1495/2016 The plaintiff has filed bill of costs inter alia assessing costs taking into account the judicial time consumed in litigation due to delay caused by defendants at Rs.1,50,000/-. On inquiry, it is stated on behalf of the plaintiff that a criminal complaint u/S 138 of NI Act was instituted by the plaintiff herein in which time was taken in tracing out the address of accused therein for which said cost has been sought.

The captioned suit was decreed by the Hon'ble Court vide order dated 29.01.2019. Costs in terms of Rule 5(f) Chapter 23 Delhi High Court (Original Side) Rules, 2018 were not imposed or assessed vide the said order. Thus, the said costs cannot be taken into account for purpose of taxation.

-2Accordingly, the memo of cost prepared by the Officer on the basis of material available with it has been checked by concerned Assistant Registrar/Administrative Officer (Judicial). The calculation made by the office is accepted and cost of the suit is taxed at Rs.3,12,800/- (Rupees Three Lacs Twelve Thousand and Eight Hundred Only).
