This petition in public interest has been filed and the grievance made is that in the award of the contract in question there is no provision for ensuring implementation of the Labour Laws like the Employees' State Insurance Act, 1948, the Employees' Provident Funds & Miscellaneous Provisions Act, 1952, Minimum Wages Act, 1948 and Contract Labour (Regulation & Abolition) Act, 1970 and various other statutory provisions. 2.

The matter is pending since 2016 and the counter affidavits and the documents filed goes to show that now all the statutory provisions are being complied with. Even though learned counsel for the petitioner vehemently argued that most of the provisions of law have not been complied with and the action is not being taken in accordance with the terms and conditions of W.P.(C) 12104/2016

the contract, we are of the considered view, that in a Public Interest Litigation we are not required to go into all these questions at the instance of the petitioner. In case even now provisions of the Employees' State Insurance Act or the Employees' Provident Funds & Miscellaneous Provisions Act are not being complied with, the petitioner is granted liberty to bring these facts to the notice of the statutory authorities implementing these provisions who are expected to take action as per law within a period of three months. Needless to emphasize that in case the statutory authorities also fail to comply with this order, petitioner shall have liberty to bring the fact to the notice of this Court in a properly constituted petition. 3.
