ARB.P. 696/2016 The learned counsel for the Respondent has handed over a letter dated 10.01.2017 sent by the Petitioner, inter alia, agreeing to appoint a sole arbitrator from the three names as indicated in the said letter. It is seen that the names of the persons suggested in the said letter are serving officers of the respondent. However, the Petitioner has waived the applicability of Section 12(5) of the Arbitration and Conciliation Act, 1996 and has agreed for appointment of any one of them as an Arbitrator. The Learned counsel for the Respondent further states that the Respondent has also agreed to appoint one of the said named persons as the Sole Arbitrator and will do so ARB.P. 696/2016 Page 1 of 2
after obtaining necessary consent from the proposed Arbitrator. The Respondent is bound down to the said statement. No further orders are required to be passed in this petition at this stage. The petition is, accordingly, disposed of.
