No.2297/2016 The present application under Section 439 of the Code of Criminal Procedure, has been filed for the grant of bail to the accused who happens to be the husband of the deceased and convicted in a case arising out of FIR No.71/2016 registered under 304-B/34 of the Indian Penal Code at Police Station Sultan Puri, Delhi. It has been submitted by the counsel for the applicant that the trial is being proceeded with and he wishes to withdraw the present application with liberty that if need arises, he may be permitted to file an application afresh for grant of bail.

In the facts and circumstances, the present application is dismissed as withdrawn with liberty that if the prosecution evidence is not concluded by 31st March, 2017, he may move an application for grant of bail.
