% 23.12.2016 Learned counsel appearing for the Central Registrar, Cooperative Societies states that they do not have any objection in case the dispute as raised is referred to arbitration. We take the statement on record.

It is noticed that the petitioner-Babu Lal Narnaulia and the second respondent-Police Officers Multi State Cooperative Housing Society Ltd. are not on lis on the issue that the dispute as raised by the petitioner can be referred to arbitration. The dispute pertains to merits.

As recorded in our last order, the respondent No.2 Society has relied upon the order dated 15th Deccember, 2015 passed in W.P. (C) No. 1828/2015, Prem Chand Vs. Police Officers Multi State Cooperative Society Ltd. & Anr.

In view of the aforesaid position, the respondent No.1 will appoint an arbitrator within 15 days from the date a copy of this order is received by them.

The writ petition is disposed of. We clarify, not having expressed any opinion on merits.
