After arguments, this appeal is disposed of with the consent order that delay in filing appearance by the appellant/defendant in the Order 37 suit is condoned subject to payment of costs of Rs.10,000/-. Costs be paid within a period of four weeks.

It is made clear that appellant/defendant will not seek unnecessary adjournments in the trial court and if unnecessary adjournments are sought with respect to the disposal of the leave to defend application, then the trial court will grant adjournment only subject to heavy costs. 3.

Parties to appear before the District and Sessions Judge, West, Tis Hazari Courts on 20.12.2017 and the District and Sessions Judge will now mark the suit for disposal to a competent court in accordance with law. Dasti to counsels for the parties.
