% 07.11.2016 Crl. M.A. No. 17274/2016 Allowed, subject to all just exceptions. Application is disposed of. W.P.(CRL) 3194/2016 Petitioners are son and wife of respondent no. 2. Present FIR No.
366/2016 under Sections 308/34 IPC was registered at P.S. Mundka against the petitioners on the complaint of respondent no. 2. Respondent no. 2 has alleged in the FIR that his son (petitioner no. 1) caught him while his wife (petitioner no. 2) gave iron rod blows to him. Respondent no. 1 submits that matter has been settled between him and the petitioners. They all are living
together in the same house.
Respondent no. 2 submits that he has no grievance against the petitioners and is not willing to pursue the FIR any further.
Keeping in mind that property disputes arose between the petitioners and respondent no. 2 and they have resolved their differences, inasmuch as are living together under the same roof, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 366/2016 under Sections 308/34 IPC registered at P.S. Mundka, which is at the investigation stage, is quashed.
