% 08.09.2016 The learned counsel for the respondents says, upon instructions of Mr. Ajit Kumar, Dy. Secretary (Legal), who is present in Court, that the earlier information given to this Court, through a sealed cover, was incorrect and the actual marks secured by the petitioner is not 119.25 but 137.25 out of 249 marks.

There is a gap of 21 points and 39 other candidates between the petitioner and the last selected one. The petitioner does not qualify for the post.

There is no merit in the petition. The petition and the application are, accordingly, dismissed.
