This writ petition has been filed challenging Note-I of the Notice dated 20.10.2016 issued by the High Court of Delhi, through its Registrar General, whereby, the revised results of the Delhi Higher Judicial Service Preliminary Examination-2015 held on 03.04.2016 have been declared.

By Note-I which is under challenge, it has been notified that the Delhi Higher Judicial Service Main Examination (Descriptive) will be held on 12.11.2016 & 13.11.2016 in the Delhi High Court premises. The petitioner has sought re-fixation of the date of the main examination contending that the petitioner and other candidates named in the notification dated 20th October, 2016, who have cleared the Preliminary Examination have not been given sufficient time to prepare for the main examination.

There is a gap of about 21/22 days between the date of the notice whereby the petitioner has been declared as successful in the Preliminary Examination and the dates fixed for the main examination. No candidate has any vested right to seek fixation of dates of an examination as per the time required by him to prepare for the examination. All the candidates who have been declared as passed in the Preliminary Examination, by the notice dated 20th October, 2015, are equally circumstanced. There is no reference in the writ petition to any rule, regulation, notification or circular which requires a specific time gap between the declaration of the results of the Preliminary Examination and the date of the main written examination.

The mere fact that those candidates who were declared successful in the Preliminary Examination, by the notice dated 26th August, 2016 got some more time for the written examination after declaration of their result is no ground for further postponement of the Main Examination, which was earlier scheduled for 9th/10th October, 2016.
