Learned APP accepts notice for respondent no. 1.
Respondent nos.2 and 3 Ms. Priya and Mrs. Archna are present in Court and accept notice.
They have been identified by SI C.B. Sharma of police station New Usman Pur.
Respondent no. 3 is mother of respondent no. 2. FIR No. 1082/2017 under Sections 451/354/354(B)/323/34 IPC and Section 12 of the Protection of Children from Sexual Offence Act, 2012 was registered at Police Station New Usmanpur on the complaint of respondent no. 2. At the time of
incident, respondent no. 2 was minor.
Now, she has attained the age of majority in the month of August, 2018. Respondent nos. 2 and 3 submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion, vide a Memorandum of Understanding dated 1st September, 2018 and have no objection in case aforesaid FIR and consequent proceedings emanating therefrom are quashed.
Affidavits of respondent nos. 2 and 3 have also been filed in support of the petition.
Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
