% 08.11.2016 Petitioner was known to respondent no.2 prior to incident.

Respondent no.2 alleged in the FIR that petitioner called her at bus stop to hand over some papers to her. She went there. He took her on his scooter to a park and molested her. On the complaint of respondent no.2, present FIR No.226/2015 under Section 354A/506 IPC was registered at police station Civil Lines.

Charge sheet has already been filed and trial is pending. Respondent no.2 and petitioner have settled their disputes with the intervention of their common friends vide Memorandum of Understanding dated 26th October, 2016. Respondent no.2 is present in Court and submits

that she has condoned the act of petitioner. She submits that she has settled the matter with petitioner on her own free will and without any undue force, coercion and pressure. She further submits that she does not wish to pursue the criminal case any further.

Keeping in mind the facts that petitioner and respondent no.2 have settled their disputes and respondent no.2 does not wish to pursue the FIR any further, in the interest of justice, FIR No.226/2015 under Section 354A/506 IPC was registered at police station Civil Lines and consequent proceedings emanating therefrom are quashed.

Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
