% 08.11.2016 CRL.M.A.17341/2016 Exemption granted, subject to all just exceptions. Accordingly, this application stands disposed of. CRL.M.C. 4160/2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No. 348/2011, under Sections 420/467/468/471 IPC, registered at Police StationModel Town, Delhi and all proceedings emanating therefrom. Counsel for the petitioner has submitted that the petitioner and the complainant are the real brothers. He has further submitted that due to misunderstanding between the parties, the elder brother lodged a complaint leading into registration of FIR No.

348/2011, under Sections 420/467/468/471 IPC at Police Station-Model Town, Delhi. He has further submitted that after registration of the FIR qua the petitioner, the relatives and the friends intervened and the matter has been settled through Mediation Cell, Rohini vide order dated 31st August, 2016. He has further submitted

that due to the misunderstanding between the parties there were civil litigation too between the parties. He has further submitted that all the civil litigations are ended by the intervention of the near relatives which resulted into the settlement dated 31st August, 2016 and further submitted that the present FIR No.348/2011, under Sections 420/467/468/471 IPC is required to be quashed to meet the ends of justice to maintain good relationship between real brothers and near relatives in near future and prays that the aforesaid FIR be quashed.

Respondent No.2/ complainant, Mr.Surjit Singh is present in Court today and is identified by the Investigating Officer, Sub Inspector Devinder Kumar of P.S. Model Town. Complainant admits that all the dispute between the parties are settled vide settlement deed 31st August, 2016. He further submits that the settlement/compromise has taken place voluntarily, without any force, pressure or coercion. He further submits that he has no objection if the present FIR in question is quashed. Looking into the above facts and circumstances, since the matter is between the real brothers and all their disputes are settled, to meet the ends of justice and to upkeep the peace in the family of the two real brothers, I deem it appropriate to quash the FIR No. 348/2011, under Sections 420/467/468/471 IPC at Police Station-Model Town, Delhi, and all proceedings emanating therefrom.
