W.P.(C) 10663/2016, C.M. No.41813/2016 Petitioner is aggrieved by the illegal and unauthorized construction which is being permitted on plot No.R-46, Prem Nagar, Phase-II, Mithila Vihar, New Delhi.

On advance notice, learned counsel for respondent no.1 has put in appearance. Her submission is that this property was inspected yesterday and on inspection it was found that the property was one year old; no fresh construction was going on. However, action has been initiated under Sections 343/344 of the DMC Act. A show cause notice has also been issued accordingly. Copy of the show cause

notice has been handed over to the petitioner. Learned counsel for respondent further submits that all actions in accordance with law shall be completed and taken against the alleged illegal construction, if any. This statement of the respondent is taken on record. It is hoped and expected that this action shall be implemented in true letter and spirit.

No further orders are called for in this petition. Petition disposed of in the above terms.
