O R D E R

The petitioner has approached this court under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 for extension of parole expiring on 06.07.2017. 2.

By order dated 30.05.2017, the petitioner was granted parole for a period of four weeks to enable him to attend the surgery of his father, which was to take place on 05.06.2017. However, the surgery could not take place as the father of the petitioner was found suffering from high fever and the surgery was postponed.

Since the surgery could not take place on 05.06.2017, the petitioner should have surrendered immediately thereafter. Now by the order of this court dated 03.07.2017, the petitioner surrendered on 03.07.2017 itself. 4.

It is submitted by the learned counsel for the petitioner that the

surgery is now fixed for 10.07.2017. The petitioner has placed on record the prescription slip and medical certificate issued by Dr. R.N. Khetarpal of R.N. Khetarpal Memorial Nursing Home, WZ-283/4, Vishnu Garden, Khyala Road, New Delhi-110018.

Fresh status report has been filed. The ASC through SI Des Raj confirms the medical prescription and the certificate placed on record by the petitioner.

In these circumstances, the petitioner be released on parole for a period of three weeks, to be counted from the date of his release, on his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Superintendent of the concerned Jail on the terms and conditions as per the order dated 30.05.2017. 7.

It is made clear that in case for any reason the surgery does not take place on 10.07.2017, he shall immediately surrender before the Jail Superintendent.

The petition is disposed of accordingly.

Copy of this order be sent to the Jail Superintendent for compliance. 10.

Copy of this order be given dasti.
